Terms of service
This is a courtesy translation. Only the German version is legally binding.
§ 1 Scope
(1) These terms apply to all contracts for the purchase of digital content concluded via this online shop between Johann Heinrich Dittmann, Taply, Münzstraße 33, 19055 Schwerin, Germany ("we") and the customer.
(2) A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A business is any natural or legal person acting in the exercise of their trade, business or profession when concluding the contract (§ 14 BGB).
(3) Deviating terms of the customer do not apply unless we expressly agree to them in writing.
§ 2 Subject of the contract
(1) We sell digital content, in particular guides in PDF format (e.g. "Taply – The NFC Card Guide"). The exact content is set out in the respective product description.
(2) The content is for general information. Revenue and results mentioned are personal experiences and not a promise or guarantee of any particular success. Success depends on many factors, in particular your own effort, the market and the location.
(3) The content does not constitute legal, tax or financial advice.
§ 3 Conclusion of contract
(1) The presentation of products in the shop is not a binding offer but an invitation to order.
(2) By clicking the order button ("Buy now" / "Pay now"), the customer submits a binding offer to purchase the products in the cart. Before submitting the order, the customer can review and correct their entries at any time.
(3) The contract is concluded when we accept the order by an order confirmation email or provide the download, whichever comes first.
(4) The contract languages are German and English. We store the contract text. The customer receives the order details and these terms by email. The terms are also available on this website at any time.
§ 4 Prices and payment
(1) All prices are final prices. As a small business pursuant to § 19 UStG, we do not charge or show VAT.
(2) There are no shipping costs.
(3) Available payment methods are shown during checkout. The purchase price is due immediately upon conclusion of the contract. Prices may be displayed and charged in other currencies; any conversion is carried out by our payment provider.
§ 5 Delivery
(1) After receipt of payment, the digital content is made available for download. The download link is shown on the order confirmation page and sent to the email address provided.
(2) To access it, the customer needs an internet connection and a program to open PDF files. The customer should save the file permanently after downloading; the number of downloads and the validity of the link may be technically limited.
§ 6 Rights of use
(1) The content is protected by copyright. Upon full payment, the customer receives a simple, non-transferable, unlimited right to use the content for their own purposes.
(2) It is not permitted to copy, pass on, sell, make publicly available or present the content as one's own, in whole or in part, unless permitted by law.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details, in particular regarding its early expiry for digital content, can be found in the withdrawal policy.
§ 8 Warranty
The statutory provisions on defects of digital products apply (§§ 327 et seq. BGB). If you have problems with the download or the file, please contact the email address given in the legal notice.
§ 9 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely), liability is limited to the foreseeable damage typical for the contract.
(3) Otherwise, liability for slight negligence is excluded.
§ 10 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Schwerin, Germany.
(3) Should any provision of these terms be invalid, the remainder of the contract remains valid.
